Ocean Point Claims:carrier applying hurricane deductible to non hurricane loss
Problem

Hurricane Deductible Applied Incorrectly

Your Florida carrier applied a hurricane deductible to a loss that wasn't caused by a named hurricane: perhaps a tropical storm, a severe thunderstorm, or a post-season event. The deductible trigger is specific.

Short answer: The hurricane deductible applies only from issuance of a hurricane watch/warning through 72 hours after termination, and only for losses from the named hurricane. Outside that window, the standard AOP (all-other-perils) deductible applies.

The correct trigger

Under Fla. Stat. 627.701, the hurricane deductible applies:

  • During a hurricane watch/warning for the state
  • Through 72 hours after the last watch/warning is discontinued
  • Only if the loss was caused by the named hurricane

Common misapplications

  • Tropical storm (not a hurricane): AOP deductible applies
  • Severe thunderstorm with high wind: AOP deductible applies
  • Loss occurring days after the watch/warning ended: AOP deductible applies

How to contest

  • Pull NOAA watch/warning timing data
  • Request the specific storm name and trigger basis from the carrier
  • Compare to the policy's deductible definition
  • Submit written dispute with evidence
