Proof of Loss

A sworn, notarized statement from the policyholder detailing the loss, the amount claimed, and the circumstances: typically required by policy.

What it is

A Proof of Loss (POL) is a formal, sworn document that policyholders submit to carriers as part of the claim. It lists the damaged property, the amount claimed, the date and cause of loss, and is signed under penalty of perjury.

When it's required

Most Florida policies require POL submission within 60 days of the carrier's request. Fla. Stat. 627.70131 sets carrier deadlines, but the POL requirement flows from the policy itself.

Why it's a trap

A poorly prepared POL can lock in an underestimated claim amount. Once you've sworn to an amount, amending it requires significant documentation and sometimes adversarial proceedings. Public adjusters prepare the POL with a full Xactimate estimate underpinning the claimed amount.

Never sign until

  • Every visible and suspected damage has been documented
  • A full Xactimate or equivalent estimate has been prepared
  • Your coverage limits and deductibles have been confirmed
