How long do I have to file a hurricane claim in Florida?

One year for a new or reopened claim, 18 months for a supplemental claim. This is per Florida Statute 627.70132, which was amended in the 2022 SB 2A reform. These deadlines are significantly shorter than the pre-reform 5-year window many homeowners still assume applies.

The deadlines

Under Fla. Stat. 627.70132 (post-SB 2A):

  • New claim: 1 year from date of loss
  • Reopened claim: 1 year from date of loss
  • Supplemental claim: 18 months from date of loss

Which deadline applies to your claim

  • You haven't filed yet: you have 1 year from the date of loss.
  • You filed and the claim was denied or closed: reopening requires filing within 1 year.
  • You filed, were paid, but later discovered more damage: supplemental claim within 18 months.

Important: "date of loss" not "date of discovery"

The deadline runs from when the loss occurred, not from when you discovered it. If Hurricane Milton struck in October 2024, your new-claim deadline is October 2025. If you didn't discover roof damage until December 2024, you still have the clock running from October 2024.


What to do as deadline approaches

  • File the claim with the carrier (formal written notice)
  • Document the loss and the date of loss
  • Retain a public adjuster immediately if coverage or scope is contested
