How to protect yourself
- Before endorsing the check, write "accepted without prejudice, claim open" on the back
- Send a contemporaneous email to the adjuster:
This payment is accepted as a partial payment. Claim remains open. - Keep a copy of the check front and back
When this becomes a problem
If the carrier marked the check "full and final" or attached a release, cashing without notation can be argued as acceptance.
