Mistake: Cashing a Partial Payment Without Notation

Partial payments are common in Florida claims. When the insured cashes a partial check without notation, some carriers later argue the payment was accepted as full settlement.

How to protect yourself

  • Before endorsing the check, write "accepted without prejudice, claim open" on the back
  • Send a contemporaneous email to the adjuster: This payment is accepted as a partial payment. Claim remains open.
  • Keep a copy of the check front and back

When this becomes a problem

If the carrier marked the check "full and final" or attached a release, cashing without notation can be argued as acceptance.
